Purchasing Policy

These Evme Purchase Terms (the “Purchase Terms”) supplements the Evme Terms of Service that can be found at Terms of Service (the “Terms”, and together with the Purchase Terms, the “Agreement”), which are incorporated herein, between you and Evme. All capitalized terms have the meanings set forth in the Terms.

Our collection and use of personal information in connection with your access to and use of the Services, whether or not you are a registered User, is described in our Privacy Policy that can be found at Privacy Policy.

1. Placing an Order
If you elect to purchase products, which may include serums, creams, cleansers, and other skincare or personal care products (collectively, the “Products”)from us, you agree to these Purchase Terms, as we may update them from time to time. We may add new Products and/or amend pricing and payment terms for existing Products, at any time in our sole discretion. After you place an order, we will review the information you provided for validity by verifying your method of payment, billing, and/or shipping address. Orders may not be accepted for delivery to certain addresses and territories. We may contact you (via email or phone) if additional information is required to accept and process your order. Invalid order information may result in delays in processing your order. For Product purchases, your receipt of an order confirmation does not constitute Evme’s acceptance of your order. Without prior notification, Evme retains the right to limit the Product order quantity and the right to refuse to sell Products to any customer for any reason or no reason. Evme reserves the right not to sell to resellers, dealers, or distributors. If we cancel your order, we will attempt to notify you using the email address you have provided with the order. If you would like to cancel your order, in whole or in part, you may have a short window of time to cancel items from your order before they begin processing. If you do not see the “Cancel Items” option in your order details, that indicates that we are unable to process a cancellation. Once you have received your order, you may return or exchange any eligible items.

    2. No Sales to Children
    Evme does not sell Products through its Service for or to children, but only to adults, who can purchase with a credit card or other permitted payment method. If you are under eighteen (18) years of age, you may use the Service only with involvement and consent of a parent or legal guardian.

    3. Subscription Products
    Evme offers a six (6)-month subscription (“6 Month Subscription”) and a twelve (12)-month subscription (“12 Month Subscription”, together with the 6 Month Subscription, the “Subscription(s)”, and the term for each Subscription, the “Subscription Term”) for the Products, as described in this Section, and you acknowledge and agree that you will comply with this Agreement associated with your purchase of any Subscriptions. The Subscriptions are available only via pre-payment in one lump-sum, upfront payment at the prices listed in this Section below. Once your payment is accepted and the Subscription is active, you will receive the following during the first month’s delivery: (i) one (1) external component (“Containers”)for each Product purchased, and (ii) packets containing the Products to insert into the Containers (“Pods”). After the first month’s delivery and beginning with the second month’s delivery, you will receive either refill Pods or additional Containers for each applicable Product purchased in the Subscription. You acknowledge and agree that: (1) you are solely responsible for checking the description with respect to each purchased Product to confirm whether you will receive a refill Pod or additional Containers during subsequent deliveries; (2) in the event that you discard any Containers for Products designated to receive refill Pods, you are solely responsible for purchasing a replacement Container, and Evme is not obligated to provide any replacement Containers without charge. Except as set forth in Section 4 below or as determined by Evme in Evme’s sole discretion, prepaid Subscriptions are not eligible for any refunds or cancellation, including refunds for any unused time remaining on a Subscription or for anything else.
    1. 6 Month Subscription. The 6 Month Subscription is available only via pre-payment at the price of $109 USD per month, for a total payment amount of $654 USD.
    2. 12 Month Subscription. The 12 Month Subscription is available only via pre-payment at the price of $99 USD per month, for a total payment amount of $1,188 USD.

    4. Subscription Fees and Automatic Renewal.
    a. Evme may make certain portions of the Service available on an automatically renewing subscription basis as detailed in Section 3 for the Products (the “Subscription Product”) for recurring fees (“Subscription Fees”). We may make any available Product on a subscription basis, discontinue subscriptions for Subscription Product, or add or amend the Subscription Fees at our sole discretion. When we add or amend the Subscription Fees, we will update these Purchase Terms. Any change to our Purchase Terms shall become effective in the Subscription Term following notice of such change to you as provided in the Terms; provided however, that if we have offered a specific duration and Subscription Fees for your use of the Subscription Product, we agree that the Subscription Fees will remain in force for that duration.  IF YOU SIGN UP FOR A SUBSCRIPTION, THE CORRESPONDING FEES AT THE RATE AS SET FORTH IN YOUR USER ACCOUNT AND/OR ON THE CHECKOUT PAGE WILL AUTOMATICALLY RENEW AT THE END OF YOUR SUBSCRIPTION TERM FOR SUBSEQUENT TERMS EQUAL IN LENGTH TO THE INITIAL SUBSCRIPTION TERM UNLESS AND UNTIL YOU NOTIFY US THAT YOU WANT TO CANCEL YOUR SUBSCRIPTION AS SET FORTH IN SECTION 4.d. BELOW.   

    b. You acknowledge and agree that the amount billed may vary due to promotional offers and changes in applicable taxes, and you authorize us or our third-party payment provider to charge your payment method for the changed amounts. If any regular payment varies in amount from the previous payment or preauthorized amount, we will provide you with notice at least ten (10) days before the payment describing the payment amount. However, if you agree to a range for any recurring payment, we will not provide you with notice so long as the payment does not fall outside of the specific range agreed to by you.

      c. For as long as your Subscription continues, you authorize us or our third-party payment provider to charge to the payment method on file on the first day of each Subscription Term the Subscription Fees for the Subscription Product, including any applicable taxes or other charges you may incur in connection with your purchase and use of the Subscription Product, subject to adjustment in accordance with the terms and conditions of this Agreement. If the payment method on file becomes invalid due to an expiration or other reason, and we are unable to charge you for the next billing period, we will provide you written notice of such declined transaction, and you will have seven (7) calendar days from such declined transaction to input a valid payment method. After such period, we may revoke your access to our Service until you input a valid payment method. If you fail to input a valid payment method within a reasonable amount of time, we may cancel your Subscription. Your Subscription is continuous until you cancel it pursuant to the terms herein or your Subscription to the Subscription Product is suspended, discontinued or terminated in accordance with this Agreement.

      d. To cancel your Subscription to the Subscription Product, you must notify us at least three (3) days before the start of the next Subscription Term using the appropriate functionalities of the Service on your settings page or by contacting us at legal@evme.comin writing and will be effective in the month following the month you provide us notice.  You will continue to receive your Subscription Product through the end of your billing period.  YOU UNDERSTAND THAT UNLESS AND UNTIL YOU NOTIFY US OF YOUR CANCELLATION, YOUR SUBSCRIPTION AND ALL CORRESPONDING FEES WILL AUTOMATICALLY RENEW, AND YOU AUTHORIZE US OR OUR AUTHORIZED THIRD PARTY PAYMENT PROVIDER (WITHOUT NOTICE TO YOU, UNLESS REQUIRED BY APPLICABLE LAW) TO CHARGE YOU THE APPLICABLE SUBSCRIPTION FEES AND ANY TAXES, USING ANY ELIGIBLE PAYMENT METHOD WE HAVE ON RECORD FOR YOU.

        e. You may cancel your Subscription to the Subscription Product at your sole discretion; however, acknowledge and agree that Evme will not refund ANY ORDER(S) IDENTIFIED AS “PROCESSING” OR “SHIPPED” ON YOUR USER ACCOUNT PAGE WHICH CANNOT BE CANCELLED.  YOU WILL BE RESPONSIBLE FOR ALL CHARGES (INCLUDING ANY APPLICABLE TAXES AND OTHER CHARGES) INCURRED WITH RESPECT TO ANY ORDER IDENTIFIED AS "PROCESSING" OR "SHIPPED" PRIOR TO THE CANCELLATION OF YOUR SUBSCRIPTION. IN THE EVENT THAT: (A) EVME SUSPENDS OR TERMINATES YOUR SUBSCRIPTION TO THE SUBSCRIPTION PRODUCT, YOUR USER ACCOUNT OR THIS AGREEMENT FOR YOUR BREACH OF THIS AGREEMENT; OR (B) YOU CANCEL YOUR SUBSCRIPTION TO THE SUBSCRIPTION PRODUCT, YOU UNDERSTAND AND AGREE THAT YOU SHALL RECEIVE NO REFUND FOR ANY PRODUCT PURCHASES THAT HAVE ALREADY BEEN FULFILLED OR PREPAID, AND ANY SCHEDULED PURCHASES WILL BE CANCELLED.  

        5. Payment Methods
        We accept various payment methods through third-party payment providers such as Shopify, including, without limitation, Mastercard, Visa, Discover, and American Express. By using our website or the Services, you agree to be bound by Shopify’s Terms of Service available at https://www.shopify.com/legal/terms.  You authorize us to supply your payment card information to our third-party payment provider for the purpose of processing your payments. By providing your payment card information, you understand that our third-party payment provider may store such information for future transactions. All payments will be charged in US Dollars; provided, however, that your payment card provider may charge you currency conversion fees. We do not have control over currency exchange rates or charges imposed by your payment card provider or bank, and we are not responsible for paying any charges or fees imposed by your payment card provider or bank. We accept various payment methods for Product purchases through our Service, including Mastercard, Visa, Discover, and American Express. We will bill your payment method when you place an order for a Product through the Service. Evme will not fulfill any Product order without authorization validation of your purchase from your payment method. All information that you provide in connection with a purchase or transaction must be accurate, complete, and current. You agree to pay all charges incurred by users of your payment method used in connection with a purchase or transaction with the Service at the prices in effect when such charges are incurred. You will pay all applicable taxes, if any, relating to any such purchases and transactions.

          6. Offers
          You acknowledge and agree that any offers made available through the Service are subject to change at any time and from time to time. Sale prices on the Service are Internet-only specials. We have endeavored to be as accurate as possible in describing and displaying the colors and other features of the Products made available for purchase through the Service; however, there is no warranty or guarantee that the colors, quality, Product descriptions, or other content of the Service is accurate, complete, reliable, current, or error-free.

            7. Shipping
            We will ship the Product(s) you purchase via the shipping method of our choice, on such other terms and conditions (such as applicable shipping and handling fees) that we may disclose to you at the time of your purchase. We will send you an email once your order has shipped, in whole or in part, giving you a tracking number and expected shipping date for each package in the order. We do not guarantee the services of any shipping service, and delivery dates and times are estimates and are not guaranteed. We will, however, use commercially reasonable efforts to dispatch the Product to you as soon as reasonably possible after you place your order. During busy times, such as holiday periods and periods of inclement weather, there may be additional processing and shipping delays. You agree to not hold Evme liable for any shipping issues. Most package carriers have a short time frame in which to initiate claims. We recommend that you inspect your package for damage immediately upon arrival. If there is a problem, contact the delivery service immediately to resolve any problems. At our discretion, we may choose to halt, or alter, the delivery of an order, even though it is in the hands of a delivery agent or shipping company. We may do this as a customer service or in cases where we suspect fraud. You agree to pay any additional charges that may arise to do circumstances in which we take such action.

            8. Returns
            Except as otherwise provided herein, Evme will provide refunds for Products purchased through the Service solely in accordance with our Return Policy.

            9. California Residents
            The provider of services is set forth herein. If you are a California resident, in accordance with Cal. Civ. Code §1789.3, you may report complaints to the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs by contacting them in writing at 1625 North Market Blvd., Suite N 112 Sacramento, CA 95834, or by telephone at (800) 952-5210 or (916) 445-1254.
